Minister Habijan at the conference “Croatian Judiciary after the Hann-Invest Judgment”
The conference was held in the aftermath of the judgment of the Court of Justice of the European Union in which the Croatian mechanism of harmonisation of case-law was declared contrary to EU law.
Minister Damir Habijan participated in the conference “Croatian Judiciary after the Hann-Invest Judgment”, held at the House of Europe on September 9, organised by the Department of European Public Law of the Faculty of Law, University of Zagreb, in cooperation with the European Commission Representation in Croatia.The conference participants discussed how to interpret the judgment of the Court of Justice of the European Union in the Hann-Invest case of 11 July 2024, which declared the Croatian mechanism for the harmonisation of case-law through registrtions judges and binding legal positions adopted at court section meetings contrary to EU law, and what changes the Hann-Invest judgment requires in the functioning of the Croatian judiciary.
“The Ministry, in cooperation with the representatives of the judiciary, is going to analyse this decision in detail and proceed to the necessary legislative amendments, taking into consideration the need to provide adequate instruments for the harmonisation of case-law. Regardless of what the new legal solution will ultimately be in respect of the harmonisation of court practice, it should be pointed out that it will be highly important in order to ensure legal certainty for Croatian citizens", said Minister Habijan.
The conference brought together prominent representatives of the academic community, the European Commission Representation in Croatia, the Court of Justice of the European Union, judges of the Constitutional Court of the Republic of Croatia and judicial officials.
