Access to information

The right to access and re-use information is regulated by the Act on the Right of Access to Information (NN 25/13, 85/15, 69/22).

The aim of the Act is to enable and ensure exercise of the right of access to information, guaranteed by the Constitution of the Republic of Croatia, and reuse of information by natural and legal persons through openness and publicity of the work of public authorities.

The right of access to information is founded on the principles of publicity and free access to information, timeliness, completeness and accuracy of information, principle of equality, principle of availability of information and principle of mutual respect and cooperation. Moreover, pursuant to Article 5(1)(5) of the Act, this right "entails the right of a user to request and receive information, as well as the obligation of public authorities to provide access to the information requested, that is, to publish information even when no particular request has been made when such publication arises from their obligation stipulated by law".

Information, within the meaning of the Act (Art. 5), means “any data possessed by a public authority, in the form of a document, record, file, register or any other form, regardless of how it is presented (written, graphic, printed, recorded, magnetic, optical, electronic or any other record)".

Pursuant to same Article, reuse of information "means the use of information of a public authority by a physical or legal person, for commercial or non-commercial purposes different from the original purpose of the information within the framework of a public function, as stipulated by law. Information exchange between public authorities for the purpose of performing functions from their respective remits shall not constitute reuse.”

The Ordinance on Types and Content of Licences Establishing Conditions for the Reuse of Information governs the types and content of the licences establishing conditions for the reuse of the information of public authorities.

The Ministry of Justice, Public Administration and Digital Transformation is entitled to compensation for the real material cost incurred by providing information to the beneficiary of the right to access and reuse information, as well as compensation of the cost of delivery of the requested information.

The compensation amounts for access to and reuse of information are laid down in the criteria referred to in Article 19(3) of the Act on the Right of Access to Information.
