Minister Malenica with representatives of the Department for the Execution of Judgments of the European Court of Human Rights

On Wednesday 15 November, Minister of Justice and Public Administration Ivan Malenica met with the representatives of the Department for the Execution of Judgments of the European Court of Human Rights of the Council of Europe. 

They discussed the implementation of judgments of the European Court of Human Rights, i.e. judgments establishing a violation of the European Convention for the Protection of Human Rights and Fundamental Freedoms, which relate to areas under the competence of the Ministry of Justice and Public Administration. 

In terms of violations of the right to a fair trial, the pending amendments to the Courts Act were discussed, which will further regulate issues related to the protection of the right to a trial within a reasonable period.

They also discussed the activities of the Ministry of Justice and Public Administration regarding the improvement of accommodation conditions for persons deprived of liberty through the adaptation and extension of existing capacities and the construction of new ones. The importance of the activities carried out by the probation service was emphasised i.e. the application of alternative sanctions, as they contribute to reducing the problem of overcrowding in prisons. In addition to the already implemented electronic surveillance for conditional release, a regulatory framework is being drafted on the execution of pre-trial home detention with electronic surveillance, which will further relieve the burden on prisons.

The Minister was accompanied at the meeting by Representative of the Republic of Croatia before the European Court of Human Rights Štefica Stažnik, Acting Director General of the Prison System and Probation Directorate Zvonimir Penić and Acting Director General of the Directorate for Human Rights, National Minorities and Ethics Danijela Gaube.
