Government session: greater consumer protection and more efficient court proceedings

At the 172nd session of the Government, Minister Damir Habijan presented three final legislative proposals - for the Civil Obligations Act, the Consumer Bankruptcy Act and the Act on the Protection of Persons Who Engage in Public Participation

Presenting the Final Proposal of the Civil Obligations Act, Minister Habijan pointed out that the aim of the amendments was to enhance consumer protection in Croatia by transposing two EU directives.

‘One concerns liability for defective products, while the other regulates common rules to promote the repair of goods’, he argued.

Referring to the Final Proposal of the Consumer Bankruptcy Act, he explained that the purpose of the amendments was to transfer cases from the jurisdiction of municipal courts to the jurisdiction of commercial courts. That, he said, would result in greater specialisation of the practitioners conducting such proceedings, but also in a more balanced burden on the judges.

As regards the Final Proposal for the Act on the Protection of Persons Who Engage in Public Participation, the Minister stated that the aim was to establish procedural safeguards to protect the rights of natural and legal persons engaging in public participation against whom abusive court proceedings had been initiated.
