Minister Habijan: European arrest warrant for Zsolt Hernádi remains enforceable

Minister of Justice, Public Administration and Digital Transformation Damir Habijan held a press conference today on the (non-)recognition of the final judgement of the Zagreb County Court in the case of Zsolt Hernadi

‘First of all, I must emphasize that the Ministry of Justice, Public Administration and Digital Transformation has not received any official information regarding the procedure on the recognition of a judgement rendered in another Member State when it comes to the judgement of the Zagreb County Court in case of Hernádi’, the Minister said at the beginning of his address.

He added that there had been no cooperation on this issue between the judicial authorities of the Republic of Croatia and the Republic of Hungary. 

‘This is an internal procedure of the Republic of Hungary concerning the review or the recognition of the legal consequences of the judgment, or the consequences of the conviction and rehabilitation’, the Minister explained.

‘The Hungarian internal recognition procedure has no legal repercussions on the final judgment of the Zagreb County Court or on the active European arrest warrant’, the Minister highlighted.

The so-called recognition procedure by the Hungarian authorities is interpreted as yet another way of questioning the proceedings that have been finally concluded with the conviction of Zsolt Hernádi, and hence questioning the Croatian legal system.

‘Mr Hernádi remains a person convicted by final judgment. The European arrest warrant remains enforceable and we expect every Member State of the European Union to arrest him if he is found on their territory’, the Minister concluded.
