Minister Habijan presents to Parliament draft amendments to the Act implementing Council Regulation (EU) 2017/1939 implementing enhanced cooperation on the establishment of the European Public Prosecutor's Office

The Regulation provides for the establishment of the European Public Prosecutor’s Office as an independent EU body responsible for investigating, prosecuting and bringing to judgment the perpetrators of offences against the Union’s financial interests

"What we are constantly promoting is that the Croatian government proposed in late 2020 that the Regulation be transposed into national legislation. By doing this in late 2020, we became one of the first EU member states to introduce the Regulation into national legislation, and at the beginning of 2021, the European Delegated Prosecutors began to work”, the Minister said.

The decentralised level of the European Public Prosecutor's Office in the Republic of Croatia consists of six European Delegated Prosecutors.

"There is often talk of European Delegated Prosecutors as some natural persons who do not belong to or did not come from the Republic of Croatia, but are some other body, which is essentially not true”, the Minister added.

The Draft Act on Amendments to the Act Implementing Council Regulation (EU) 2017/1939 proposes the insurance of the European Delegated Prosecutors through mandatory health and pension insurance funds.

The insurance contributions would be paid by the Republic of Croatia through the competent State Attorney's Office, which would be in charge of calculating the contributions.

The monthly contribution basis would be the gross salary that a European Delegated Prosecutor would receive if he/she continued to hold the judicial office from which he/she was appointed European Delegated Prosecutor.

Furthermore, the Act proposes to introduce the right to an increased length of pensionable service for European Delegated Prosecutors, as it is provided for the judicial officials working on cases within the scope of the Office for the Suppression of Corruption and Organised Crime, so that every 12 months of actual service is counted as 16 months of pensionable service.

The funds necessary for the implementation of this Act for six European Delegated Prosecutors are estimated at EUR 153,000 for 2025 and EUR 154,000 for 2026, as the Minister pointed out.
