Minister Habijan: Livestream of secret evidentiary actions impermissible, harms both accused person and entire criminal proceedings

Minister Habijan commented on information leakage and activation of Article 307a of the Criminal Code on Nova TV

On Wednesday 20 November, Minister Damir Habijan commented in Nova TV’s news programme Dnevnik on the topic of information leaks and activation of Article 307a of the Criminal Code.

“I cannot comment on the decisions of the State Attorney’s Office, but I believe that it is impermissible to livestream the entire pre-trial investigation or secret inquiries i.e. secret evidentiary actions in public, without regard to the proceedings before judicial authorities or wherever they are to be conducted. This harms both the accused person and the entire proceedings”, the Minister pointed out.

With regard to the activation of Article 307a of the Criminal Code, which concerns the unauthorised disclosure of the content of an investigative or evidentiary action, the Minister clarified: “We have had Article 307 in the Criminal Code all along, which also prohibited communication of the facts legally classified as secret to the public, so this is not a novelty or a peculiarity of the Croatian criminal legislation, and it is prescribed by the Criminal Code precisely for the benefit of criminal proceedings.”

The Minister also said that the charges against the former health minister prove that there are no untouchables.
