Minister of Justice, Public Administration and Digital Transformation Damir Habijan said the model according to which the State Attorney General is competent to resolve any conflict of competence between the EPPO and the national prosecution service is applied in 14 other EU countries.
"As regards the conflict of competence, the Republic of Croatia has regulated it identically to 14 other Member States, in that it is resolved by the State Attorney General. The European Commission and the European Union (EU) have not provided another solution to the issue", Habijan said after the Government session.
In case of a change in the acquis communautaire on this matter, Croatia would align its provisions accordingly, Minister Habijan added.
As he explained, the Regulation through which the EPPO was implemented in Croatia does not refer to a conflict of competence or who should decide it. Instead, this was left to the Member States to decide, and Croatia chose the solution identical to the 14 other EU Member States. Therefore, Croatia has nothing to align with in this regard at the moment.
The Minister also referred to a constructive meeting with European Chief Prosecutor Laura Codruța Kövesi a few days ago, pointing out that the Chief Prosecutor emphasised clearly that cooperation with Croatia was very good.
