Criminal offences against life and limb
Prescribing criminal offenses against life and limb and punishing their perpetrators protects the most important legal goods of the constitutional order - human life and body. This group of criminal offences includes an entire range of prohibited behaviors, from murder, through aggravated murder to bodily injuries of varying severity.
Legal descriptions of criminal offenses (from the Criminal Code)
Murder
Whoever murders another,
shall be punished by imprisonment for a term of no less than five years.
Aggravated murder
A punishment by imprisonment for a term of no less than ten years or long-term imprisonment shall be imposed on whoever:
1. murders another in a cruel or insidious way,
2. murders a person who is particularly vulnerable due to their age, severe physical or mental disability or pregnancy,
3. murders a close person they have abused before,
4. murders another out of greed, ruthless revenge, hatred or other base motives,
5. murders another for the purpose of committing or concealing another criminal offence,
6. murders an official person in connection with their performance of official duties.
Bodily injury
(1) Whoever physically injures another or impairs their health
shall be punished by imprisonment for a term not exceeding one year.
(2) Whoever commits the offence referred to in paragraph 1 out of hatred, against a close person or a person particularly vulnerable due to their age, severe physical or mental disability or pregnancy, or in the capacity of an official person performing official duties or a responsible person exercising public authority,
shall be punished by imprisonment for a term not exceeding three years.
(3) The criminal offence referred to in paragraph (1) shall be prosecuted by private action.
Serious bodily injury
(1) Whoever inflicts a serious bodily injury on another or severely impairs their health
shall be punished by imprisonment for a term between six months and five years.
(2) Whoever commits an act referred to in paragraph (1) out of hatred, against a close person or a person particularly vulnerable due to their age, severe physical or mental disability or pregnancy, or in the capacity of an official person performing official duties or a responsible person exercising public authority,
shall be punished by imprisonment for a term between one and eight years.
